Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Security Monitoring Services — False Alarm Policy

Southern Charm Security LLC may offer or facilitate access to professional monitoring services in connection with alarm systems We install. By enrolling in or activating monitored alarm services, You acknowledge and agree to the following:

Customer Responsibility

You are solely responsible for the proper use and operation of any alarm system installed at Your property. This includes but is not limited to properly arming and disarming the system, ensuring all authorized users are trained on system operation, keeping access codes confidential, and promptly notifying Us of any changes to Your contact list or emergency contacts.

False Alarms

A false alarm is any alarm signal that results in a dispatch response by law enforcement, fire, or emergency medical services where no actual emergency exists. False alarms may result in fines, fees, or penalties assessed directly by local municipalities, counties, or emergency service agencies. You are solely responsible for any and all fines, fees, or penalties assessed against You or Your property as a result of false alarms, regardless of cause.

Southern Charm Security LLC does not issue credits, refunds, or reimbursements of any kind related to false alarm fines, fees, penalties, dispatch charges, or any costs associated with a false alarm response. This policy applies regardless of the circumstances surrounding the false alarm, including but not limited to equipment malfunction, user error, power outages, environmental factors, or third-party interference.

Repeated False Alarms

Repeated false alarms may result in local authorities placing Your property on a restricted response list, which may delay or eliminate emergency response to future alarm signals. Southern Charm Security LLC assumes no liability for delayed or denied emergency response resulting from Your property’s false alarm history with local authorities.

Monitoring Service Terms

Monitored alarm services may be provided through a third-party monitoring center. The specific terms, conditions, and pricing of monitoring services are governed by a separate monitoring agreement entered into between You and the monitoring provider. These Terms and Conditions do not supersede or replace that agreement.

SMS Messaging Terms and Conditions

If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at contact@southerncharmsecurity.com.
Carriers are not liable for delayed or undelivered messages.
As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive messages and frequency varies based on user interaction and typically does not exceed 10 messages per month. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

You can cancel the SMS service at any time. Just text “STOP” to the +1 (706) 522-5050. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Our Service may contain links to third-party websites or services that are not owned or controlled by the Company. The Company has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. We strongly advise You to read the terms and conditions and privacy policies of any third-party websites or services that You visit.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions. Upon termination, Your right to use the Service will cease immediately.

Limitation of Liability

To the maximum extent permitted by applicable law, the entire liability of the Company and any of its suppliers under any provision of these Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service, or 100 USD if You have not purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever, including but not limited to damages for loss of profits, loss of data, business interruption, personal injury, loss of privacy, property damage, theft, or any damages arising out of or in any way related to the use of or inability to use the Service, even if the Company has been advised of the possibility of such damages.

Southern Charm Security LLC does not guarantee that the installation or use of any security camera system, alarm system, lighting system, or other equipment will prevent crime, theft, property damage, personal injury, or any other loss. Security systems are intended as a deterrent and monitoring tool only. The Company assumes no liability for any losses, damages, or injuries that occur despite the presence of installed equipment.

Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means some of the above limitations may not apply to You. In these states, each party’s liability will be limited to the greatest extent permitted by law.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Neither the Company nor any of its providers makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information provided through the Service; or (iv) that the Service or emails sent from or on behalf of the Company are free of viruses or other harmful components.

Governing Law

The laws of the State of Georgia, United States, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Fannin County, Georgia.

Disputes Resolution

United States Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo or that has been designated by the United States government as a “terrorist supporting” country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter, nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, please stop using the Website.
